First Theater Shooting Lawsuit Blames Everyone But James Holmes

James HolmesWell, it's happened. It's been, what, five days (?) since the horrific shooting in a crowded Aurora, Colorado theater, and a lawsuit has already been filed by one of the survivors. Torrence Brown Jr. apparently has a long list of people he wants money from.

Brown's lawsuit says the Century 16 theater, alleged shooter James Holmes' doctors, and The Dark Knight Rises creators at Warner Bros. studios are all to blame for the extreme trauma he's suffering. Pardon me for being ... confused?

What about the alleged shooter himself? Didn't he DO this? If you look at the trio of defendants his lawyer talked to TMZ about it, it seems an awful lot like Brown has got a lawsuit set up that blames everyone BUT the person who prosecutors say is responsible for the Aurora tragedy.

From a humane standpoint, it's hard to criticize anything the survivors are doing at this point because they are likely suffering from exactly the kind of extreme trauma that Brown says is the basis for his lawsuit. I don't doubt for a moment that he is in extreme pain. Brown was incredibly lucky to survive the massacre that killed his friend, Alexander AJ Boik.

Right now, my heart goes out to him. It isn't time for criticisms of his motives -- as those who accuse him of trying to "cash in" on the tragedy have already done. And yet, I think it's fair to say I'm troubled by the choices he's made with this lawsuit. He took this public. He made this choice to move so quickly. And at the very least, Brown is extremely misguided.

And nothing drives that home like the words his lawyer, Donald Karpel, used to explain why Warner Bros. should pay because victims first confused the violence happening in the theater for that on-screen in the Dark Knight movie. "Somebody has to be responsible for the rampant violence that is shown today," Karpel told TMZ.

Somebody has to be responsible? Somebody?

How about the person who actually perpetrated the horrific crime in a crowded theater last Friday morning? This isn't a game of pin-the-tail on the donkey. You don't just pick "somebody" and ask them to pay. Blaming a movie for being scary or doctors for not being able to control everything their adult patient did gives the real monster here the easy out.
