I’ve had my share of early-morning and late-night annoyances. The guy across the street from a summer place I used to frequent kept his porch light on all night, and it was like a headache-inducing beacon invading my dreams. He also mowed his lawn first thing in the morning. Thing was, he did so with his shirt off, and he was built like Andy Roddick, so all was forgiven.
Apparently Phil Ray Gage of Oklahoma does not have the same charms -- or he pushed his neighbors too far -- because he was very nearly taken away in handcuffs while mowing his lawn. His crime? Mowing too early.
Before you look, ask yourself how early is too early. 9:30 a.m.? 7:30 a.m.? How early do you think it was?
It was 4:30 a.m. What! The hell! He should have gone to jail just to get some sleep!
Police came to his house and arrested him, then slapped the cuffs on him, he says. In the end, they just gave him a ticket -- which he's fighting.
Actually, I think the guy has a case. First of all, he’s a carpenter, which involves hot, difficult work that starts at 6 in the morning. If I had a tough job like that, and I were still a good enough homeowner to actually mow my lawn, I would expect a medal.
Plus, for his own safety, he knew it was a better idea to do outside yardwork before the sun rose in the scorching, drought-plagued South. Keeping grass short is one way to save water, too. So in terms of efficiency, 4:30 a.m. was actually a smart time to do the chore.
But the thing that really got my goat was this: Gage was mowing a neighbor’s yard in addition to his own, just to be a good guy. And this wasn't a spur-of-the-moment decision; he says he's been an early-morning mower for 10 years, without a complaint. In fact, he’s the kind of guy who has all his neighbors' phone numbers, just in case they need help. The only neighbor who wasn't in his Rolodex? The fella who called the cops.
Which leads me to this question: Can’t you open your window and ask the guy to save the lawn mowing for later? Barring that, can’t you use a white-noise machine or earplugs? Barring that, once you have involved the fuzz, can’t the officer just ask the guy to stop rather than giving the guy a ticket? That’s the most ridiculous part.
Anyway, if that overzealous officer is looking for something to do, she can come here to San Francisco and arrest my neighbors to the left for having nicer tomatoes than me, my neighbors to the right for updating their paint job before I do, and the rampant raccoons for being gross. Never mind the crazy pit bull up the street.

Good grief, he was ARRESTED for cutting his grass? How stupid!! Growing up in the south, I KNOW how hot it can get and if you want to get anything outside accomplished, you had better do it early. It's too dangerous to be out there cutting grass in the middle of the day when it's 100 plus. So what if he woke a few people up? My husband works rotating shifts, and sleeps during the day when he works midnight shift. Yup, that's when EVERYONE is out cutting their grass and putting a roof on their garage. Turn on the AC, pull down the shades and put in some earplugs if you have to. I bet the nosey neighbor who turned this guy in, is the same one who would complain if the grass got too high!!! Some people are just never happy, and need to mind their own dang business.
I do not wish to hear a lawn mower at the ungodly hour of 4:30 in the morn.It's selfish.And he probably did the neighbors lawn because it bothered him.And who knows if this guy is a bully and people are afraid to complain.It's his mouth going off about what is convenient for him.I notice that so far no one has come to his defense say for you writer where are the neighbors for this good Samaritan to back him up?
The neighbors had every right to call the police for him mowing at 4:30am, why? BECAUSE HE WAS DISTURBING THE PEACE mowing his damn lawn at 4:30am! I have an infant who doesn't sleep through the night so any sleep I can get is precious to me especially when I have to care for her and my 2 1/2yr old through the day. Do people have no respect nowadays?! I had to call the cops on my neighbor for putting their barking dogs outside at 3am!
The article above says he wasn't arrested, only ticketed. There are noise ordinances for a reason-he shouldn't violate them.
I'm sure the neighbors would have complained if the yard was overgrown too!
I live in OK, I also work a day job and for a time also worked a night job AND went to school fulltime so I understand having a busy schedule but to say you have to mow @ 4:30 in the morning so it doesn't interfere with your day job is a load of you know what. 95% of Americans work day jobs and we don't have to mow in the wee hours of the morning. Does it get hot in OK in the summer? You bet it does but that's still no excuse. Mow in the evening like most people do or mow at a more decent morning hour on your days off. And for all of you harping on the neighbor for calling the police? What if he worked the late shift and just got home and got to bed? He was well within his rights to complain. I sure would.
It wouldn't have phased me. The only thing that does phase me. Someones bass shaking my walls to the point that the kids wake up for the day. Did the guy even go over and talk or just call the cops.
