Real Life 'Cupcake War' Makes Me Want to Order Pie

cupcakeUh-oh. Looks like there's trouble in Cupcakeland. And what's eating the dessert powers-that-be is whether the word "sprinkles" can be trademarked. A judge on Food Network's Cupcake Wars is starting a cupcake war of her own making. And this time, it's out of the kitchen and into the courtroom.

Candace Nelson's company Sprinkles Cupcakes filed a federal trademark-infringement lawsuit against Fairfield, Connecticut-based cupcake shop Pink Sprinkles. The baker extraordinaire says that the similarity in names is likely to cause confusion in the marketplace.

Candace's husband Charles told sources that it's "not about the competition," but I'm calling your bluff, Chuck. The way I see it: Pink Sprinkles isn't that far away from one of Sprinkles Cupcakes' 11 locations in New York City. I think they want cupcake fans on their turf instead.

Come on, Candace. Can't we all just indulge in a few treats and get along?

Honestly, you mean to tell me that there are NO other cupcake stores in the entire continental United States that use the word "sprinkles" in their name? That's like ice cream stores not being able to use the words "tasty" or "whipped." Sprinkles Cupcakes' attempt to keep "sprinkles" all for themselves makes naming any similar store nearly impossible. In fact, I think it's just downright mean! Why don't you try to trademark the word "cupcake" while you're at it too, eh?

Do me a solid. Head over to Pink Sprinkles' website and look at the "about us" tab. There, you'll see the story of Diane, her husband, and her two kids who are excited about being Fairfield's first cupcake shop. I'm thinking this little bakery is Diane's project, her something-to-do, now that her two kiddos are growing up. And I can guarantee you that when they came up with the name, taste-tested the flavors, and cranked up their ovens for the first time, she wasn't trying to steal Candace's thunder. Not in the slightest.
