Dad Shot & Killed After Road Rage Incident on the First Day of School

rearview mirrorThe first day of school ended in heartache for two kids in Michigan, when their dad was shot and killed during an apparent road rage incident as he was on his way to pick them up. Derek Flemming, 43, was out with his wife Amy when they were almost hit by a speeding pickup truck.

A family attorney told reporters that the truck driver then began tailgating them -- "driving so close they couldn't read the vehicle's front license plate." At a stoplight, Flemming allegedly got out of his car to confront the driver, and the 69-year-old shot him.

Lawyer William Moore said, "Derek got out and went up to the window and said, 'What's your problem?' and got shot."

The shooter has yet to be identified, but is in jail pending an investigation. It's not known what charges may be filed over the killing.

Moore told the Detroit Free Press that the victim's family is having a very difficult time coming to terms with their loss. "[His] wife and the kids, they're so upset that they don't want to deal with anything ... they're in denial. There is no win in this, from both sides."

"I know he was a great father and his kids loved him," Moore continued. "That much I know because I've seen the way he interacted with them over the past few years. The kids are sweethearts. They don't get it yet. They're basically in shock."

The Flemming's have two kiddos, a 5-year-old boy and a 7-year-old girl, so it's no wonder they're in shock over losing their dad. And I can't even imagine the pain his wife is feeling right now. She was in the car with him before he got out, and had to have witnessed the whole thing.

It's so heartbreaking that something that should have ended up just being an annoying thing that happened that day instead turned to tragedy.

Do you think road rage should factor into cases like this if it goes to trial?
