Teresa Giudice Will Likely Divorce Joe If He Gets Deported

With all eyes on Joe Giudice as he finishes up his prison sentence, many have wondered what will happen to his marriage with a certain Real Housewives star. Well, Teresa Giudice said she'll leave her husband should he get deported ... and seeing how a judge ordered him to leave the country after his prison sentence, it's pretty safe to assume that will happen.

    "This man is the one and only love of your life, but what you're saying is that you would split up … that's what you're saying?" host and new dad Andy Cohen asks her about leaving her husband, Us Weekly reports.

    "I mean, unless my kids say, Mommy I want to move to Italy," Teresa tells Andy. "Gia's going to college next year; I haven't spoken to Milania or Audriana about it, we haven't gotten there yet; and Gabriella already voiced her opinion to me. She was like, 'That would be so hard for me, mommy.' She doesn't speak the language. She's like, 'That would kill me even more.'"

    "You know, I want somebody with me every day. I know exactly what happens. You know, I'm sure he'll be with other women. It happens. We do the long-distance thing, it's not going to work. I'd be like, 'Bye bye.'"

    Teresa and Joe Giudice, who've known each other since they were kids, tied the knot back in 1999. The couple have four daughters together: Gia, 18, Gabriella, 14, Milania, 13, and Audriana, 9.
  • In 2014, Joe and Teresa pleaded guilty to 41 counts of fraud, resulting in prison sentences for the pair.

    Teresa served 11 months in 2015, with Joe starting his 41-month prison sentence back in March 2016. Us Weekly reports the reality show pair also had to pay Uncle Sam and the New Jersey Department of Treasury, even though their bankruptcy case got dismissed.

  • Back in October, a judge ordered Joe to be deported back to Italy once he's released from jail.

    "Based upon the law, I find you deportable and ineligible for any kind of relief," Judge John Ellington reportedly told the reality star dad about his deportation fate. "Mr. Giudice, no matter how this turns out, I wish you the best. I decided this case as a matter of law."

    Once deported, Joe likely won't be able to visit his kids in the US as he's not a citizen and was convicted of a crime. "I do not think Joe can win in appeals court. A person who is convicted of fraud like this and an aggravated felony conviction is very hard to get around," immigration attorney Edward Shulman told Us Weekly about the likelihood of Joe getting the ruling overturned.

    "Maybe there will be some nuance in the statute of the conviction, but it is unlikely. If the immigration court of appeals denies Joe again, Joe will not be allowed back into the country, not even for a vacation ....

    Joe is not an illegal alien. He has a green card, but a green card is a privilege, not a right. If someone has been here since they were 1 day old, it does not matter if they have also committed an aggravated felony. The charge of fraud was above $10,000, which makes it an aggravated felony and that is the basis for deportation. There is no relief for Joe now. Since he has a green card and has been convicted of an aggravated felony, the law states that deportation is the result."

    At the end of the day, it's Teresa and Joe's decision to do whatever they feel is best for their marriage and family. If they split, they split, and if they don't, they don't.
