Josh Duggar Is Trying Really Hard to Avoid Having to Talk About Cheating

He just can't escape the scandal. Josh Duggar has filed papers to dismiss Danica Dillon's lawsuit against him. The adult film star sued the disgraced 19 Kids and Counting alum for assault and battery, claiming that he twice paid her for "rough sex."

Josh's lawyer, Jeffrey A. Conrad, argued that "the Plaintiff has not alleged that Defendant attempted by force to do injury to her." Court documents also claimed that Dillon "did not provide anything more than a formulaic recitation of the elements of assault and/or battery," adding, "Her labels and conclusions are not adequate, particularly because she states that she consented to physical and sexual contact in exchange for payment."

Basically, Josh allegedly paid her for sex and now she's trying to get a heck of a lot more money out of it. He has not responded to the claims that he paid Dillon for "rough sex," but he did admit to being a cheater-cheater-pumpkin-eater when he was exposed in the Ashley Madison hack last August.

He immediately checked himself into a faith-based rehab center, where he's been recovering hiding from the world.

A source close with the Duggars told ET, "In court, it doesn't matter who is right or wrong. It's who can prove it. And that's just the plain and simple way the world works."

The insider continued, "Sometimes it's unfair, it's just the way it is. If you can't prove it, regardless of if it happened or not, that's what the court goes by, is evidence ... Josh is a smart guy, and I hope to god he is getting the help he needs."

Dillon is seeking $500,000 in damages for her "physical and emotional injuries." She has also said that while she consented, it "felt" like she was being raped.

Look, it's hard to know what really happened here, if anything. But the fact of the matter is that Josh is going to have to talk about his cheating ways, whether he wants to or not. His wife Anna says she wants their marriage restored, and maybe that's possible, but he's going to have to fess up to his sins.

He might not be willing to do that on his own, but when you're taken to court, you don't really have a choice.
