Halle Berry Pulls Out of Film, Readies for Custody Battle

Bad news for Halle Berry fans: She's pulled out of the upcoming romantic comedy New Year's Eve, set to start filming this week in New York. Worse news for the overall quality of American cinema: She's being replaced by Katherine Heigl.

(This comes after Heigl cancelled her role in Adaline, a sci-fi/fantasy movie, citing that she didn’t want to go back to work right away because of her child, but I suspect she's just physically incapable of participating in anything that isn't a rom-com.)

Berry's reason for backing out of her movie is also child-related, and it sounds like a sad story. She's apparently getting ready to go to court with her ex, Gabriel Aubry, over custody of their 2 1/2-year-old daughter Nahla.


Berry's rep told People.com:

Halle has serious concerns for her daughter's well-being while in the care of her father for any extended period of time and is prepared to take all necessary steps to protect her. She has attempted to resolve these custody issues amicably with her daughter's father, Gabriel Aubry, directly, but given his lack of cooperation, Halle has no choice but to seek swift judicial intervention.

With these kinds of shots being fired from Berry's camp, it's clear whatever friendly relationship those two had after their April breakup is no more.

For Aubrey's part, he filed court papers December 30 seeking to be formally recognized as Nahla's father and to establish that he'll share custody. Obviously, Berry has no intention of letting this happen.

No word on what started the custody issues, but RadarOnline recently published a rumor that Berry was having Aubrey
followed by a private investigator. Sounds far-fetched, but maybe something was observed that led to Berry's concern over her child's well-being?

Whatever's going on, it's ultimately a tragedy for their daughter. Here's hoping they can get the situation squared away and figure out how to amicably co-parent.
