'Teen Mom' Amber Portwood Should Get Custody Now That She's Out of Prison

Amber portwood release from prisonHave you heard? Amber Portwood just got out of prison, and already she's put ex-boyfriend Gary Shirley on notice. This Teen Mom wants her kid back! And why shouldn't she get custody of little Leah?

Joint custody, at least?

Amber was greeted by a camera crew when she came out of the Rockville Correctional Facility, and she was eager to talk about her little girl, who she's reportedly seen only once since voluntarily entering incarceration. Asked if she's got joint custody in mind, Amber told TMZ:

That's the goal. That's what's going to happen.

And why shouldn't she?

Time in prison does not automatically mean someone is an unfit mother (or father) -- not when the crime that landed you on the inside is not related to your failings as a parent.

It's true Amber wasn't always the greatest mom. She first landed in legal trouble because she beat up Gary right in front of Leah!

But, and this is a big but, people make mistakes. What's important is learning from them, growing as a person, getting better.

That's what prison, believe it or not, is all about. It gives criminals time to cool their heels and think about the consequences of their actions, time to straighten out and decide to fly right. It gives them time to reflect on what's really important -- like their kids.

Amber took anger management and parenting classes behind bars. She got clean and sober. She did everything on the inside that she's supposed to do.

So why not give her joint custody of Leah? Not full -- after all, Gary has been doing a great job as a single dad, and there's no reason he shouldn't continue to have ample amount of time with his little girl.

Leah has been through so much already. The 5-year-old should have a chance at a normal life -- with both her mom and dad in the picture.

And Teen Mom fans might get a look-see at what that life is like! Gary tweeted last night that he's filming, and there are reports that MTV paid for Amber's dad to fly to Indiana for her prison release!

How should custody be handled for a mom (or dad!) just getting out of prison?

No. Just no. Being in prison does mean you're not a fit parent. Why should she get custody without proving herself. You dont any common sense. And I hate to burst your bubble but people who go to jail usually end up going back. Its not likw they just become a different person magically.

Yet again, you write about things YOU DO NOT UNDERSTAND. In the state of Indiana she is going to be lucky to UNSUPERVISED visitation for the next few years. Then she will have to spend YEARS fighting to get joint custody, even then she probably won't. My friend became addicted to drugs, and tried to commit suicide, and lost custody of her child. YEARS later after being clean for YEARS she is still fighting to get custoday back, and the courts still won't let her. That is the way Indiana works, there is no such thing as forgiveness, and the woman is ALWAYS dirt.

absolutely not.  she, or anyone just getting out or prison, needs to prove they are able to be a good parent to their child.

How about NOT jerking around this poor child. She seen her mom once in the past few years. Let them spend a little time getting to know each other again before you put her through such a massive change. And Amber should spend some time adjusting without the added responsibility of caring for a child.

So you want to give a child back to someone who is physically abusive? (just because it was her husband it's still physical abuse). How long do you think it will take before she starts hitting and possibly even kills her daughter? If you think she has the right to have kids why don't you let her watch yours ? Having a child is a privilege, not a right. She needs to prove she can be a parent and get psycological help before she should be allowed anywhere near her daughter.

I think at this point she should get supervised visits, then unsupervised, then work up from there. She has seen the child 1 time in 2 years, she doesn't know her anymore.

No. She needs to prove herself. Studies show that a big percentage of people who serve time come out worse than they were before.

To All The Haters: I was never a fan of Amber Portwood, but following her story, she has made a great amount of progress!! She is out of prison, && yet people still want her NOT TO SEE HER CHILD?!?! like really?! did anyone ever think that keeping Leah away from her will take away the motivation to keep her wanting to live a happy, positive lifestyle? By letting her see her daughter, it gives her something to look forward to, to keep changing for. You take away her daughter and you take away her reason to live. I'm sure any mother, regardless of her parenting style/lifestyle, would agree to that && if you don't, I'm sorry you are just dumb & probably shouldnt be a parent!! ... & go ahead, & try to tear my comment to shreds, i'm secure as a parent & myself that any haters with rude opinions make me laugh instead of being PO'd. :)
