A teacher who miscarried her baby after being kicked in the stomach breaking up a fight in the Bronx has decided not to press charges against the boys who did it.
According to the New York Post:
The teacher, Lissedia Batista, 27, is refusing to cooperate for fear that the boys, a ninth-grader and an 11th-grader, would wind up entered into the city's criminal-justice system, cops said.
Is that incredibly brave or incredibly stupid? Consider the facts:
The well-liked teacher was rushing to break up a fight between the two boys who were arguing over a chair. One of the boys kicked her in the stomach as he lunged over the chair and sent her tumbling to the floor. She was rushed to the hospital, but it was too late to save her baby.
As much as it makes sense that these children should be punished for what they did, it also makes no sense to ruin the rest of their childhoods over what was likely a tragic accident. Kids fight, hormones and all that. And, from the report, it doesn't look like they intentionally struck the teacher. She was trying to break up the fight and ended up in harm's way.
Described as "high school horseplay," do these actions really warrant these children being sent off to juvenile hall? Clearly the teacher herself knows them better than we do, so if she says no, then I believe her. On the other hand, wow.
Whatever Batista is paid, it's clearly not enough. That is the kind of teacher I want teaching my children someday. She put their happiness and their future ahead of her own. It's hard to imagine what it must feel like to be so full of hope, four months along in your pregnancy, and then to have it be taken away because of your work.
Job hazard? Maybe. But kids will be kids and this sounds more like a tragic accident than a malicious, intentional murder.

Absolutely these kids should be punished - simply for their behavior and not based on the tragedy for the teacher. These high school kids are too old to be behaving in such a way. I worked as an urban teacher and I would NEVER get in the middle of a fight b/t kids. It's just not worth it. No teacher should be faced with such a decision. Again...how were these kids raised? What a bunch of punks. They should be expelled...and whatever else they get. They need to know that there are consequences to their actions. If they end up in juvenile detention so be it...it sounds like they are on the road there anyway.
Bet those boys will think twice before fighting again because of the tragic results to a very innocent person in this scenario...
They were FIGHTING in school. Last I checked, that was against the rules. Their actions caused a life to be lost. In the "real world", that could be considered negligent homicide. In school, it's only worthy of a detention?
I don't care if they intended to hurt her or not. 9th and 11th grade. That's 15 and 17. They know better. Their behavior caused the death of an innocent child. They should face the consequences. And if it means Juvie, so be it.

At 75 having raised 4 kids and now grandmother to 4 I know that one of the problems with kids today is that they are handed everything they want from birth, they are never taught that other people have rights also and they grow up not knowing that there are results to their behavior because we protect and shield them way too much. I know this is currenlty unpopular and I am sure child psychiatrists the world over will just write me off as a senile old lady but I firmly believe that a good hard smack to the glueteus maximus does far more good than harm if their little psyches learn to behave then much will be accomplished. When I was a kid we had to go out back to the apple tree and pick out our own switch when discipline was needed and we grew up law abiding, loving, people.
I agree that the kids are definitly in the wrong and because of their behavior they should be punished. If they get sent to Juvie what will they learn? How will this affected them in life? I doubt they will sit in there and think about how bad they feel. Most likely they will sulk and whine until their time is up. Let's face it these are grown boys fighting over a chair. I don't think that they think that deeply. There should be some sort of punishment to fit the crime so to speak. Maybe make them volunteer at a hospital in the maternity ward. Let them see the precious lives of those babies and then maybe they will think about the life they took. I would hope they have apologized at least.
