Breastfeeding Mom Who Lost Custody of Babies for Smoking Pot Speaks Out (VIDEO)

daisy bram familyIf you listen to the police audio tape of mom Daisy Bram crying in agony when child protective services took her children away from her, it's truly heart-wrenching. "My babies! My babies!" she screamed when they removed her 28-day-old son Zeus from her arms along with her 15-month-old son Thor back in September. Her crime? Possession of marijuana. But in Butte County, California, it is legal to grow pot. And Bram, along with husband Jayme Walsh, both have legal documentation allowing them to use marijuana for pain management. The county also allows them to grow it.

Three weeks prior to their arrest and seizure of their children who were placed in a foster home, police investigated the family's cannabis garden and gave it the okay. An officer even reportedly wished them luck with the baby. But then the unthinkable happened. You can hear the tape next, but be warned. It's very emotional and there is some language at the end.

You can hear the pain in her voice and no mother -- no parent -- should ever have to go through that. Yes, it was CPS, an agency that is put together to help save children's lives. But at the same time, this is seemingly a family who lived within the law, and whose babies weren't in danger. Of course, that depends on your stance on medical marijuana. Still, the people at CPS are strangers to this mother and father. Their babies were taken from them to live with strangers. For four months. I can't even imagine not being able to be with my children for four months. Bram calls it a witch hunt and the family has set up a website Free My Babies with details.

Fresh in the news the other day, however, was the story of a 19-year-old mom who left her infant on the hood of her car as she drove away, drunk and high. I feel this is much different than a mother who legally smokes a little pot at home for the pain in her arm. Even if she is breastfeeding.

Bram recently spoke to ABC News 10 about how she feels her kids were taken away because she was breastfeeding and smoking pot. She talked about how she doesn't believe enough THC can pass through breastmilk to cause any harm to the children. Tests revealed that there was trace THC in the hair from Thor, her older son, but the baby didn't have enough hair to test. Daisy also mentions how mothers drink, smoke cigarettes, eat genetically modified foods, and this is all seen as okay for a nursing mom. But a mom who smokes medical marijuana can have her children taken from her for months.

Bram and Walsh were charged with felony marijuana possession with intent to sell. Police found a 38-plant garden and 56 plants inside the home. Remember this is all legal in Butte County ... as long as their intent was to smoke it themselves and not sell it. The child abuse charges were dropped.

At the end of the audio, you can hear Daisy saying how she followed the law and asked those taking her babies away if they felt good about what they were doing. I can't imagine that they did. In this case, I don't think anyone "wins" -- and those children, having to be away from their parents for four long months ... all the milestones missed, the precious time a mother and father should have with their children ... gone. And for what? All because this seemingly peaceful family had some pot, which was within the law? Was it the fact that Daisy was breastfeeding?

They will never get that time back, but I hope they never have to go through something so horrifying again.

What do you think of Daisy Bram's story? Should they have taken the children from the home? Do you believe smoking pot while breastfeeding is enough of a "crime" to have children go to CPS?

Breastfeeding is very tradition way of eating for babies. Breastfeeding is most secure food for babies and it is very healthy as well. So we need to give our babies breastfeeding more and more until they are not bigger than 3years.

So having pot in a house is considered dangerous around children but yet having some "legal" drugs like alcohol or medication aren't ? And all this people posting comment about how irresponsible she is to smoke pot while breastfeeding, don't you know that doctor prescribes Tylenol and other chemicals drugs to women that just gave birth ? it is natural healing against chemical, and guess what side police officer stand for..

I live in Butte County and both CPS and Sheriffs department are out of control here. There are MANY cases of people with legitimate grows being harassed, having their property seized (and never returned) and their lives turned upside down for years. There are also too many stories of CPS overstepping their boundaries and taking questionable actions against parents who do NOT deserve it... while simultaneously doing NOTHING about home situations that result tragic endings. Check into the case of the mentally handicapped mom who had her baby taken away because he was "failing to thrive." Did I mention he was born with a cleft palate, he WAS gaining weight and his mother was doing EVERYTHING possible to get him care and had an amazing support system? I hope this family fights and wins.

What is WRONG with you people???  Do some effing research before you demonize something most of you seem to know NOTHING about!!  Recently, a MEDICAL study....done by DOCTORS and PROFESSIONALS, revealed that cannibinoids (the active ingredient in marijuana) is NATURALLY found in breastmilk.  It acts as a appetite stimulant and helps babies to be hungry.  There are also NUMEROUS studies done on breastmilk and what toxins are able to pass through the breastmilk AND the blood-brain barrier of the baby.

To the woman who said that MTV did a "real life" show (cause THATS credible) and also claims that pot will cause all kinds of developmental problems makes me laugh.  For most of you who are criticizing this woman, obviously you are not educated enough to understand how biology and nature actually work.  People have been using this plant for THOUSANDS of years for just about every use......just because we have science to prove whether or not we have it in our system.....but have yet to PROVE that it has adverse affects on adults and children, does not automatically mean its bad.  WAKE UP people.....this is simply a prohibition on a plant that threatens the livelyhood of Big-Pharma, textile industries, government programs (DEA, ATF, etc), and even the food industry.........when will people realize this?  Leave this woman alone, she didn't hurt her kids and her life doesn't really affect why even spew hate?

ugh research people . any study done correctly i.e in jamacia NOT the U.S.  where it is part of their culture and way of life and also where results are not CONTAMINATED by participants usng tobacco alcohol and other narcotics  in junction with ganja medical or not  will show there are NO harmful or negative side effects  on the baby in utero or breastfed nor to the mother . im so sorry ths happened to that poor mother she did absoluely NOTHING wrong the only way her children wee harmed was by being riped from her arms and cast off in the system for months .

allison hanson i wish there were more educated people in the world like you i sware reading your post made me so happy to know im not the only person who knows how to do research

She should have been formula feeding if she had to smoke pot. Plenty of parents didn't breast feed due to medication they had to take. I get that sometimes your health comes first but you also should be using formula if you have to smoke pot or take medication.

It is so much better to smoke pot and breastfeed than give the baby man made formula. I feel for this mother. This should have never happened to her.

Seems like your all anti pot. I think it's funny that you all think a little THC is bad while breast feeding when they proscribe OxyContin and oxycodon as subsitutes for medical marijuana , your all truly dumb, yes subjecting your kid to weed is bad! But it's not going to harm the child my mom smoked every day pregnate and breast feeding I came out perfect I know tons of mothers that have also, I'm tired of people talking about stuff that they truly have no clue about, and what if they were bi polar or had some depression and smoking made them happy would you rather them being around arguing yelling mad parents , or relaxed happy caring parents, never seem a family pick weed over baby food or diapers unless they were on harder drugs. So all you idiots that have NO clue about any of this save your comment and save your time because you just look stupid

Wow people, you all have access to a computer obviously, do a little research!! Studies done by MEDICAL PROFESIONALS have shown that smoking pot while breastfeeding has NO ill effects on the child. I can't believe that there are still people who consider pot to be a drug. And these are probably the people who have no problem with downing more than a few 'legal' beers every night, in front of their kids.
