Breastfeeding Mom Who Lost Custody of Babies for Smoking Pot Speaks Out (VIDEO)

daisy bram familyIf you listen to the police audio tape of mom Daisy Bram crying in agony when child protective services took her children away from her, it's truly heart-wrenching. "My babies! My babies!" she screamed when they removed her 28-day-old son Zeus from her arms along with her 15-month-old son Thor back in September. Her crime? Possession of marijuana. But in Butte County, California, it is legal to grow pot. And Bram, along with husband Jayme Walsh, both have legal documentation allowing them to use marijuana for pain management. The county also allows them to grow it.

Three weeks prior to their arrest and seizure of their children who were placed in a foster home, police investigated the family's cannabis garden and gave it the okay. An officer even reportedly wished them luck with the baby. But then the unthinkable happened. You can hear the tape next, but be warned. It's very emotional and there is some language at the end.

You can hear the pain in her voice and no mother -- no parent -- should ever have to go through that. Yes, it was CPS, an agency that is put together to help save children's lives. But at the same time, this is seemingly a family who lived within the law, and whose babies weren't in danger. Of course, that depends on your stance on medical marijuana. Still, the people at CPS are strangers to this mother and father. Their babies were taken from them to live with strangers. For four months. I can't even imagine not being able to be with my children for four months. Bram calls it a witch hunt and the family has set up a website Free My Babies with details.

Fresh in the news the other day, however, was the story of a 19-year-old mom who left her infant on the hood of her car as she drove away, drunk and high. I feel this is much different than a mother who legally smokes a little pot at home for the pain in her arm. Even if she is breastfeeding.

Bram recently spoke to ABC News 10 about how she feels her kids were taken away because she was breastfeeding and smoking pot. She talked about how she doesn't believe enough THC can pass through breastmilk to cause any harm to the children. Tests revealed that there was trace THC in the hair from Thor, her older son, but the baby didn't have enough hair to test. Daisy also mentions how mothers drink, smoke cigarettes, eat genetically modified foods, and this is all seen as okay for a nursing mom. But a mom who smokes medical marijuana can have her children taken from her for months. 

Bram and Walsh were charged with felony marijuana possession with intent to sell. Police found a 38-plant garden and 56 plants inside the home. Remember this is all legal in Butte County ... as long as their intent was to smoke it themselves and not sell it. The child abuse charges were dropped.

At the end of the audio, you can hear Daisy saying how she followed the law and asked those taking her babies away if they felt good about what they were doing. I can't imagine that they did. In this case, I don't think anyone "wins" -- and those children, having to be away from their parents for four long months ... all the milestones missed, the precious time a mother and father should have with their children ... gone. And for what? All because this seemingly peaceful family had some pot, which was within the law? Was it the fact that Daisy was breastfeeding?

They will never get that time back, but I hope they never have to go through something so horrifying again.

smoking it for pain,or for some it helps with anexity,but makes them paranoid at the same time,go figure.but she should'not have lost her children over her smoking unless she was doing it to the point of being careless and wouldnt be able to care for her kids as well as needed. having that many plants,seems like child can bring about the wrong kind of attention,or catch the house on fire,so many things.

  however,it makes me wonder where the priorities of our great nation are at. just read about a 7 and 9 yr old boy that raped a 2 yr old,and ppl think they shouldnt be punished.

  if the parents were caring for their kids,and no signs of negelect and are HAPPY,then back off them.she needs to formula feed her baby and not worry about trying to get her uterest down,bc hey,if ur smoking while breast feeding,it doesnt seem like babies healthy is top on list. it baffles me to think where things are heading.

PEOPLE GIVE MARIJUANA UNDER DR. SUPERVISION TO CHILDREN!!!! directly!! legally!!! if you think a trace amount found in breast milk affects them negatively then allllll the children being given marijuana in this country should be taken away as well. And all the kids whose parents take prescription drugs, as well as smoke cigaretes while pregnant and have a beer or two while nursing. fuck it, lets just make a law that states "anyone that consumes any mind altering substances or stimulants whether legal or not cannot have children" keep in mind cofee,sugar,and over the counter medications are stimulants and therefor considered a drug.

where do the restrictions end? The family was wronged, hands down, end of story. Those claiming marijuana in small doses while breastfeeding is wrong are simply uneducated and either talking out of your behinds or reading biased studies with false information.

I don't think her punishment fit the crime considering the situation. If the family was cleared before this happened then it's cruel to turn around and take away that security. If the kids were well cared for and kept away from the plants I fail to see an issue. Many women do worse while breastfeeding and that is legal. Not like the babies was smoking it and it was effecting their lungs. If you read up on this subject (or at least smoking while pregnant) you will find out that the test conducted showed no difference between pot smoking mothers and non smoking mothers. Actually in the long run the children that were from the smoking mothers had HIGHER intelligence levels. The only thing that showed different were very slight difference in cognitive ability - Just so you have all the facts there. And the smoking parents were said to spend more time with their kids, and read to them more. This was all gathered from the first page of google search results. At least they can't use the 'laced street drug' excuse, as they grew theirs themselves :3 Just my two cents! I didn't personally, but I know other mothers who did. Babies are happy, healthy and thriving! Just remember it's not our place to judge the lives of others until there lives start hurting someone else. Those kids were not harmed and look health with loving parents. I see no problem here, move along folks!!

When doctors can prescribe women medications that are a hundred times worse for themselves and their children without batting an eye then ganja should be the least of our worries.

There are no links supporting a negative effect on children drinking breastmilk while the mom uses pot. There arent ANY! A mom whos addicted to prescription drugs gets to keep her baby but a mother who has a natural lifestyle gets her kids taken away? There in NOTHING negative about mariguana! NOTHING! there are studies. As mom who uses pot for medical reasons and takes care of her child way better than any other alcoholic junk feeding moms who rely on daycare to raise their children, I AM ENRAGED! People need to get ocer the negative stigma that society has put on mariguana. There are far more worse cancer strinking drugs out there that the FDA has approved but somehow weed is the evil of all "drugs".

wow, this is ridiculous!  They should not have taken the kids, and you people with the over the top judgemental attitude of "she should never get her kids back" need to stop reading these things and get over yourselves.  I don't smoke pot, although I did years ago, but if it were legal for medical purposes in my state, I would GLADLY do that as opposed to the pain medications prescribed by doctors.  Oh, and all of you judgementals... at least she wasn't on Vicodin... this was a better choice.

I just wanna ask one thing to all the people on here speaking about marijuana and how it was being past to the kids thru the breast milk.

What study did you look at that made you conclude marijuana has damaging effects?

Also when you looked at this medically founded repeatable test and it told you how damaging it can be, did you compare that to how damaging feeding your children process fake freinken food or breathing polluted air is?

Someone should have stepped in a long time ago based on what she named those kids. Damn potheads. Who needs a study on how damaging it is when you name your kids Thor and Zeus? thats proof enough.
